PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY. THESE TERMS CONTAIN AN ARBITRATION AGREEMENT, CLASS ACTION WAIVER, AND JURY TRIAL WAIVER. BY USING THIS WEBSITE OR PURCHASING SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS.
1. Introduction
Welcome to STATE100 PLLC ("STATE100," "we," "us," or "our"). STATE100 is a professional limited liability company that provides medical services through licensed medical providers using telehealth technologies.
These Terms & Conditions ("Terms") govern your access to and use of the STATE100 website, services, consultations, subscriptions, and any related communications (collectively, the "Services").
By accessing the website or purchasing services, you acknowledge that you have read, understood, and agreed to these Terms and our Privacy Policy.
If you do not agree, do not use the website or Services.
2. STATE100 Is a Medical Practice
STATE100 is a clinical medical practice. Medical services are provided by licensed medical providers practicing with STATE100, including physician assistants and physicians, in accordance with applicable state laws.
All diagnoses, treatment decisions, prescriptions, and medical recommendations are made by licensed providers based on information you provide, medical history and symptoms, clinical judgment, and applicable standards of care.
STATE100 does not provide emergency medical services. If you believe you are experiencing a medical emergency, call 911 or go to the nearest emergency room.
3. Telehealth Services & Consent
STATE100 provides services via telehealth, which may include secure electronic intake forms, telephone consultations, video consultations (when required or available), and secure messaging.
Telehealth involves certain limitations and risks, including but not limited to technical issues, communication limitations, and the inability to perform in-person physical examinations.
Before receiving telehealth services, you will be asked to review and sign a Telehealth Consent form before your first consultation. This consent acknowledges the nature of telehealth, potential benefits and risks, and your right to withdraw consent at any time.
You have the right to request referral to in-person care at any time if you believe telehealth services are not meeting your needs.
4. Eligibility
To use STATE100 Services, you must be 18 years of age or older, reside in a state where STATE100 providers are licensed to practice, and provide accurate, truthful, and complete medical information.
By using the Services, you represent and warrant that you are at least 18 years of age. STATE100 reserves the right to decline services if treatment is not clinically appropriate or permitted under applicable law.
5. Accuracy of Information
You represent and warrant that all information you provide to STATE100 is true, accurate, current, and complete.
Providing inaccurate or incomplete information may result in delayed care, denial of services, or termination of your relationship with STATE100.
6. Services Offered
STATE100 may offer medical services including, but not limited to, hormone optimization, metabolic health and weight management, sexual wellness, peptide-related care (when clinically appropriate), and related evaluations and follow-up care.
Not all services are appropriate for every patient. No treatment is guaranteed.
7. Consultations, Fees & Payments
Standard Consultation Fee
The Standard Consultation Fee is $249. This fee is required before labs are ordered or treatment is initiated. Consultation fees are separate from medication, lab, and shipping costs.
Weight Management Subscription
If approved by a provider and enrolled, subscription pricing starts at $250 per month. The subscription begins after the initial consultation has been completed and paid. The subscription may include prescribing medications that are disclosed at checkout.
Your subscription includes monthly access to your provider for check-ins. Most patients schedule a 15-minute visit every 4–6 weeks, typically during dose adjustments, side effect management, or when questions arise. Additional support is available between visits through our secure messaging platform.
Additional visits beyond the included monthly access may be required and billed separately.
Other Services
For hormone optimization, peptides, sexual wellness, and other services, the Standard Consultation Fee of $249 applies (unless otherwise disclosed). Medication, pharmacy, shipping, and lab costs are additional and vary.
All prices are in U.S. dollars unless otherwise stated.
8. Pharmacy & Medications
STATE100 is not a pharmacy.
If a medication is prescribed, fulfillment occurs through third-party pharmacies. Medication availability and pricing vary. Prescriptions are issued only when clinically appropriate. STATE100 does not guarantee any specific medication.
Some medications may be used off-label, which will be disclosed during consultation and informed consent. Off-label prescribing is a legal and common practice in medicine when supported by clinical evidence and provider judgment.
9. No Guarantees
Medical outcomes vary by individual. STATE100 makes no guarantees regarding treatment effectiveness, weight loss results, hormone levels, or symptom improvement.
All care is individualized and based on clinical judgment.
10. Subscription Cancellation & Refund Policy
Subscription Cancellation
To cancel your subscription, contact hello@state100.com at least 7 days before your next billing date. Cancellations take effect at the end of the current billing cycle. No partial-month refunds are provided for subscription cancellations.
Refund Policy
Due to the nature of medical services, consultation fees are non-refundable. Medication and shipping charges are non-refundable once processing begins. Subscription fees are non-refundable for the current billing cycle.
Refunds are provided only when required by law or explicitly stated in writing.
11. Medical Records Access
You have the right to request access to your medical records in accordance with HIPAA and applicable state laws.
To request your medical records, contact hello@state100.com. Requests will be processed within the timeframes required by applicable law.
12. Privacy & HIPAA
Your privacy is important to us. STATE100 complies with HIPAA and applicable privacy laws. Use of Services is subject to our Privacy Policy, which explains how your information is collected, used, and protected.
Electronic communications are not guaranteed to be fully secure.
13. State-Specific Disclosures
Telehealth regulations vary by state. Depending on your location, additional disclosures or requirements may apply, including information about your provider’s licensing, your right to request in-person care, and how to file complaints with your state medical board.
State-specific disclosures, if applicable, will be provided to you before or during your consultation. You may also request this information by contacting hello@state100.com.
14. Acceptable Use
You agree not to misuse the website, attempt unauthorized access, interfere with security features, use the Services for illegal purposes, or impersonate another individual.
STATE100 may suspend or terminate access for violations.
15. Intellectual Property
All website content, trademarks, logos, text, and materials are the property of STATE100 or its licensors.
You may not copy, reproduce, distribute, or exploit any content without written permission.
16. Termination
You may terminate your relationship with STATE100 at any time by contacting hello@state100.com.
STATE100 may suspend or terminate Services if required by law, medical appropriateness changes, or Terms are violated.
Termination does not waive outstanding payment obligations.
17. Disclaimer of Warranties
THE SERVICES AND WEBSITE ARE PROVIDED "AS IS" AND "AS AVAILABLE." STATE100 DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE EXTENT PERMITTED BY LAW.
18. Limitation of Liability
To the fullest extent permitted by law, STATE100 shall not be liable for indirect, incidental, consequential, or special damages.
STATE100’s total liability shall not exceed the greater of $100 or the fees paid to STATE100 in the prior 12 months.
19. Indemnification
You agree to indemnify and hold harmless STATE100 and its providers from claims arising out of your misuse of Services, violation of these Terms, or false or misleading information you provide.
20. Arbitration & Class Action Waiver
Any dispute arising from these Terms, the website, payments, or administrative matters relating to your account or subscription shall be resolved by binding arbitration, on an individual basis only.
"Administrative matters" include, but are not limited to: billing disputes, subscription management, account access, refund requests, and service availability. This arbitration clause does not apply to disputes regarding the clinical standard of care, medical malpractice, or clinical treatment decisions, which remain subject to applicable state law.
No class actions. No jury trials. Arbitration is governed by the Federal Arbitration Act.
This provision does not limit rights that cannot legally be waived under applicable law.
21. Communications (Email & SMS)
By providing contact information, you consent to receive appointment reminders, service notifications, and administrative messages.
Marketing messages are optional and may be opted out at any time.
Electronic communications are not encrypted and may carry risk.
22. Governing Law
These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law principles.
23. Modifications
STATE100 may update these Terms at any time. Continued use of the Services constitutes acceptance of updated Terms.
